High-End Auctions, LLC Terms and Conditions

1. INTRODUCTION

HIGH-END AUCTIONS, LLC is different than other auction sites because we offer our members an opportunity to buy and sell valuable items without the anxiety and complications associated mass-marketing type auctions. We only serve those buyers and sellers that are interested in a straightforward approach to buying and selling items Online.

First, we do not accept items for sale with a value of less than $500 or more to eliminate small ticket items. Second, we minimize the possibility of disputes by making sure that items offered for sale are high quality, and in good condition. Third, we expect buyers to be willing to pay a fair price for the items they wish to purchase, and not to make ridiculous offers that insult the seller. Fourth, we insist on high-resolution pictures and accurate descriptions so that the buyers know what to expect. Fifth, and most importantly, we do not want unhappy sellers or buyers. Participating in HIGH-END AUCTIONS.com must be a positive experience for members. Your satisfaction is our goal.

2. TERMS AND CONDITIONS

As a member of HIGH-END AUCTIONS, LLC, you agree to the following:

1. Sellers must have a credit card number on file to pay HIGH-END AUCTION fees that are assessed against their account. We also accept electronic checks, and funding sources such as PayPal.

2. Both sellers and buyers agree to be fair and honorable in their dealings with each other.

3. All listings must be made in the appropriate category, and sellers are not allowed to use brand names and descriptions that do not specifically apply to the item they are selling.

4. Members are not allowed to list items that are prohibited or otherwise restricted as set forth in Addendum 1.

5. Members must be at least 18 years old, and competent to enter into legally binding agreements.

6. Members are required to pay for items purchased on the Web site within the time frames specified under PAYMENT AND SHIPPING below. The only exception would be an instance where the description of the item and/or the condition has been altered after the item was listed for sale.

7. Sellers are required to ship (or deliver) items that have been purchased within the time frames specified under PAYMENT AND SHIPPING below.

8. Members are not allowed to participate either directly or indirectly in shill bidding or otherwise interfere with another member's auction.

9. All members will be identified by a Member ID in the auction process, and buyer and seller feedback will be optional for all transactions.

10. When you leave feedback on this Web site, you state whether you would do business with a particular buyer or seller again. You also indicate your level of satisfaction with the transaction.

This is the only form of feedback that we allow. We encourage users to contact buyers and sellers via e-mail through this Web site when they have questions concerning a feedback rating.

11. Members will not allowed to transfer their Member ID and feedback to another party without our written approval.

12. Members are not allowed to distribute SPAM or other inappropriate communications to other members of HIGH-END AUCTIONS.

13. Members are not allowed to use viruses or any technologies that threaten the integrity of the HIGH-END AUCTIONS' network and Web site.

14. Links to other Web sites are strictly prohibited.

15. Members shall be solely responsible to assure that nothing in the items offered for sale on HIGH-END AUCTIONS is in violation of any copyright or trademark laws or intellectual property rights or any other rights of anyone as part of their listings on our Web site.

16. Members shall not collect and/or distribute information about buyers and sellers on this auction site without written permission of HIGH-END AUCTIONS and its members.

17. Members shall not end auctions early in order to sell an item directly to a buyer.

18. Bids are considered legally binding agreements between the buyer and seller.

3. PAYMENT AND SHIPPING

1. The buyer and seller shall contact each other within three (3) days from the time the auction ends to arrange payment and delivery.

2. Payment shall be made within ten (10) days after auction ends unless other arrangements are made between the parties.

3. Shipping or delivery of the item(s) purchased shall be made within five (5) days from the date of payment by the buyer unless other arrangements are made between the parties.

4. In the event payment is not made in accordance with Payment and Shipping Paragraph 1 above, the seller has the right to offer the item to the next highest bidder under the same Terms and Conditions set forth herein or relist the item.

5. If the item shipped is not as described in the auction ad, the buyer shall have the right to return the item for a refund less the shipping cost.

4. FEES AND SERVICES

Members are responsible for paying all fees assessed against their accounts by HIGH-END AUCTIONS as set forth in Addendum 2.

5. LIABILITY

1. Members shall hold harmless and indemnify HIGH-END AUCTIONS, LLC, its partners, officers, directors, agents, subsidiaries, employees, and joint venture participants from any and all claims of any kind or amount resulting from offering for sale, or purchase of any item involving HIGH-END AUCTIONS or its Web site. Such indemnification shall include but not be limited to attorney fees and costs.

2. Because we do not have control over the Internet or any of the services associated with that network including, but not limited to, servers and other ancillary equipment, HIGH-END AUCTIONS, LLC shall not be held responsible for service outages that interrupt auctions in progress. In the event of such difficulties, we will restart your auction upon your request.

6. DISPUTES

HIGH-END AUCTIONS, LLC encourages its members to resolve disputes directly between themselves. See Seller's/Buyer's Tools.

7. PRIVACY

Please refer to our Privacy Statement set forth in Addendum 3.

8. NOTICE

Legal notices shall be sent to HIGH-END AUCTIONS, Attention David L. Wilner, P.O. Box 2340, Novato, CA 94948-2340, USA.

These Terms and Conditions maybe changed from time-to-time upon 30 days notice to HIGH-END AUCTIONS members, and posted in this section of the Web site.

ALL AUCTIONS ARE SUBJECT TO APPLICABLE STATE AND FEDERAL LAW.

Violation of any of the Terms and Conditions set forth herein may result in termination of your membership.
